Effective Date: November 4, 2026
Welcome to CheckGuard Terms and Conditions (the "App"), developed and operated by Explato ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the App in connection with your Shopify store.
By installing, configuring, or using the App on your Shopify store, you agree to be bound by these Terms. If you do not agree to these Terms, you should not install or use the App. Continued use of the App following any published updates constitutes your acceptance of the revised Terms.
CheckGuard is a compliance and dispute protection platform designed for Shopify merchants. The App provides tools to collect, document, and verify explicit customer consent prior to purchase completion:
While the App provides verification tools, we are strictly a software provider. We do not provide legal advice, and using the App does not guarantee automatic compliance with regional privacy regulations such as GDPR or CCPA. You remain responsible for ensuring your store policies meet applicable legal requirements.
As a merchant using CheckGuard, you agree to:
To link consent events with customer purchases and generate valid dispute defense records, the App accesses minimal customer information via Shopify APIs under approved Protected Customer Data access:
We act solely as a data processor on your behalf for this information. We never sell, monetize, or use customer data for marketing or advertising purposes.
The App operates on a monthly or annual subscription model, which may include a free trial period. All pricing, billing, invoicing, and trial management are handled exclusively through Shopify App Pricing. Subscription charges are billed directly by Shopify and appear on your regular Shopify invoice.
If you cancel your subscription or uninstall the App, access to the App features terminates in accordance with Shopify billing rules.
Because all financial transactions are processed by Shopify, refund inquiries are governed by Shopify billing policies. We do not process credit cards or store payment credentials directly. Refund requests may be reviewed on a case by case basis through Shopify Partner channels.
The App is provided on an "as is" and "as available" basis. We make reasonable efforts to ensure continuous service, but we do not warrant that operation will be uninterrupted or completely error free.
Third party updates made by Shopify to checkout layouts, themes, or APIs may occasionally require adjustments. We work promptly to maintain compatibility, but we are not liable for sales interruptions resulting from platform level changes.
To the maximum extent permitted by law, Explato shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business reputation, arising from your use of or inability to use the App.
You acknowledge that you remain solely responsible for your store legal agreements, chargeback outcomes, and regulatory compliance.
You may terminate your agreement with us at any time by uninstalling the App from your Shopify admin. We reserve the right to suspend or terminate access if you violate these Terms or misuse our infrastructure.
